InstaMG Healthcare Private Limited is a technology intermediary that facilitates connections between users, licensed retail pharmacies, third-party registered medical practitioners, and delivery partners.

InstaMG:

• Does not manufacture, stock, or sell medicines directly

• Does not issue medical prescriptions

• Does not provide medical advice

All medicines are sold by licensed pharmacies, and all prescriptions (where applicable) are issued by third-party registered medical practitioners.

2. Eligibility

To use the Platform:

• You must be at least 18 years of age, or use the Platform under parental/guardian supervision

• You must provide accurate and complete information

• You must comply with all applicable laws and regulations

3. User Responsibilities

You agree to:

• Provide correct personal, delivery, and contact information

• Upload valid and authentic prescriptions where required

• Use the Platform only for lawful purposes

• Not misuse, resell, or abuse medicines ordered through the Platform

InstaMG reserves the right to suspend or terminate accounts involved in misuse, fraud, or violation of these Terms.

4. Orders & Fulfilment

• Orders placed on InstaMG are routed to nearby licensed retail pharmacies

• Medicine availability, pricing, and delivery timelines are determined by the pharmacy and delivery partner

• Estimated delivery times (e.g., 30 minutes*) are indicative and may vary due to availability, location, traffic, or other factors

InstaMG is not responsible for delays caused by pharmacies, delivery partners, or external circumstances.

5. Prescription-Based Medicines

• Prescription medicines require a valid prescription

• Uploaded prescriptions may be reviewed by the pharmacy or registered medical practitioner

• Orders may be cancelled if prescriptions are invalid, unclear, or non-compliant

InstaMG does not modify or generate prescriptions.

6. Doctor Consultations

• Online consultations are provided by independent third-party registered medical practitioners

• InstaMG only facilitates the connection and does not control medical decisions

• Medical advice, prescriptions, and treatment outcomes are solely the responsibility of the consulting doctor

7. Pricing & Payments

• Prices are determined by the pharmacy fulfilling the order

• Applicable taxes, delivery charges, or service fees may apply

• Payments are processed through secure third-party payment gateways

• InstaMG does not store card, UPI, or banking details

8. Cancellations & Refunds

• Cancellation and refund eligibility depends on the order status and pharmacy policies

• Prescription medicines, once dispatched, may not be eligible for return except as required by law

• Refunds, where applicable, are processed to the original payment method

9. Third-Party Services

The Platform integrates services from:

• Pharmacies

• Doctors

• Delivery partners

• Payment gateways

InstaMG is not liable for acts, omissions, or service quality of third parties beyond its role as a facilitator.

10. Intellectual Property

All content on the Platform, including logos, trademarks, designs, and software, belongs to InstaMG or its licensors.
You may not copy, modify, distribute, or misuse any content without written permission.

11. Limitation of Liability

To the maximum extent permitted by law:

• InstaMG shall not be liable for medical outcomes, medicine efficacy, adverse reactions, or misuse

• InstaMG shall not be liable for indirect, incidental, or consequential damages

• InstaMG’s liability, if any, shall not exceed the amount paid by you for the specific service

12. Indemnity

You agree to indemnify and hold harmless InstaMG from any claims, losses, damages, or expenses arising from:

• Your misuse of the Platform

• Submission of false or invalid information

• Violation of these Terms or applicable laws

13. Suspension & Termination

InstaMG reserves the right to:

• Suspend or terminate access without notice

• Cancel orders in case of suspected fraud, misuse, or policy violations

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.
Courts located in Delhi NCR shall have exclusive jurisdiction.

15. Changes to Terms

We may update these Terms from time to time.
Continued use of the Platform after changes constitutes acceptance of the revised Terms.
